1. Application general terms and conditions of sale Webshop B2C <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Through its website and webshop (the “Webshop<\/b><\/strong>“), PLASTIGI NV, better known by its commercial names Valiente\u00ae and Valientea\u00ae, offers an online platform for the sale of its Products (as defined below).<\/p>

These general terms and conditions of sale (the “Terms <\/b><\/strong>and<\/b><\/strong>\u00a0Conditions<\/b><\/strong>“) apply to all purchase agreements concerning the purchase of the Products (the “Contract”<\/b><\/strong>), between you (the “Customer<\/b><\/strong>“) and PLASTIGI NV, with registered office at 2200 HERENTALS, Lenskensdijk 3 and with company number 0406.043.681 (“PLASTIGI<\/b><\/strong>“).<\/p>

For the purposes of these Terms and\u00a0Conditions, “Customer<\/b><\/strong>” shall mean any natural person acting for purposes which are outside his or her trade, business, craft or profession (in particular, a consumer (\u201cconsument<\/i><\/em>\u201d) within the meaning of Article I.1.,2\u00b0 of the Belgian Code of Economic Law (\u201cWetboek van economisch recht\u201d<\/i><\/em>).<\/p>

By ordering Products through the Webshop, the Customer agrees to the following Terms and\u00a0Conditions and undertakes to comply with them.<\/p>

These Terms and\u00a0Conditions shall apply exclusively to the Contract, except for express prior written deviation to that effect by PLASTIGI, in which case the other provisions of these Terms and\u00a0Conditions\u00a0shall continue to apply in full.The Terms and Conditions are always available and consultable via the Webshop. The customer has the option to save and print these Terms and Conditions. The Terms and Conditions are also sent with the order confirmation.<\/p>

PLASTIGI reserves the right to modify and\/or supplement these Terms and Conditions at any time. The amended Terms and Conditions\u00a0will be communicated to the Customer by e-mail. Orders already placed and Contracts resulting therefrom shall always remain subject to the Terms and Conditions applicable at the time of the order. \u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

2. Offers and Products <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

The products offered by PLASTIGI (the “Products<\/b><\/strong>“) are those sold through the Webshop at the time the Customer places his\/her order.<\/p>

The information PLASTIGI posts about the characteristics of the Products in the Webshop, including technical descriptions and photographs, is for illustrative purposes only. Although all Products are described as faithfully as possible, it is nevertheless possible that minor deviations occur, that mistakes are made or that the information offered is incomplete, contains material errors or is not up-to-date. Inaccuracies or substantial errors in the offer do not bind PLASTIGI and PLASTIGI cannot be held liable for them.<\/p>

The offer is valid while supplies last and may be changed or withdrawn at any time. PLASTIGI cannot be held liable for the unavailability of any Product.<\/p>

PLASTIGI reserves the right to apply specific conditions to a particular offer, such as, for example, a limited period of validity. If an offer has a limited period of validity or is made under other conditions, this\u00a0will be expressly stated in the offer.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

3. Ordering through the Webshop <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

If the Customer wishes to purchase a Product from PLASTIGI’s Webshop, he must place an order for it through the online order method and follow the steps as indicated in the Webshop.<\/p>

It is the Customer’s responsibility to enter the correct data when placing the order. The Customer shall inform PLASTIGI of any change in these details. If the Customer provides incorrect data, this may result in additional costs. The Customer cannot recover these additional costs from PLASTIGI.<\/p>

When the order is placed, the total amount owed by the Customer is clearly indicated. Products can only be paid for online and must always be paid for at the time of ordering. After payment, the order becomes final and can no longer be changed or cancelled by the Customer.<\/p>

After placing the order and after the aforementioned payment has been accepted by the system, an order\u00a0confirmation will be sent to the Customer via e-mail with an overview of the ordered\u00a0Products.<\/p>

PLASTIGI reserves the right to refuse or cancel orders in the event of stock exhaustion or if an item is no longer available, as well as in cases of Force Majeure. PLASTIGI is also entitled to refuse or cancel an order if the Customer has significantly defaulted on prior orders..<\/p>

In the event that, after the Customer has placed an order and the Contract has been concluded, it appears that one or more Products included in the order are unavailable, PLASTIGI will inform the Customer via e-mail or in writing that the order will be cancelled in whole or in part, or split up. If necessary, PLASTIGI\u00a0may propose a substitute Product to the Customer.<\/p>

If PLASTIGI cancels an order and the Customer does not agree to the proposed alternatives, the Contract shall terminate by operation of law. PLASTIGI cannot be held responsible for this, nor for any damages that may result. Where applicable, the Customer shall not be entitled to any form of compensation.<\/p>

In case the Customer has already paid for the Products, PLASTIGI will refund the paid amount. The Customer will be\u00a0notified\u00a0of this via email. PLASTIGI will carry out the refund as soon as possible and at the latest within 14 days after the cancellation of the order.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

4. Price and payment <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Unless expressly stated otherwise at the time of entering into the Contract, the price for the Products purchased by the Customer from PLASTIGI is immediately due and payable.<\/p>

The prices are those listed in the Webshop at the time the Customer places the order. PLASTIGI is entitled to adjust its prices stated in the Webshop from time to time. Obvious or material errors in the quotation do not bind PLASTIGI and may be corrected by PLASTIGI even after the conclusion of the Contract.<\/p>

Prices are expressed in euros and include VAT and other taxes. The costs of delivery, transport and shipping and other possible additional costs (such as, for example, administrative costs) are not included. These costs are charged separately and are in addition to the price.<\/p>

These additional costs will be indicated explicitly and at the latest in the last step of the online ordering\u00a0process.<\/p>

If, after placing the order, the Product purchased by the Customer is sold at a discount, the Customer is not entitled to payment of the price difference.<\/p>
